MRI Toolkit Terms of Use

These Terms of Use ("Terms") are an agreement between you and MRI Toolkit LLC ("MRI Toolkit," "we," "us," or "our"), a company based in Houston, Texas. They cover your use of the MRI Toolkit mobile app for iOS and Android, the website at mritoolkit.com, and any related content, features, and purchases (together, the "Service").

By downloading, opening, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What MRI Toolkit Is

MRI Toolkit is an educational app for MRI technologists, students, and others learning about magnetic resonance imaging. It includes MRI physics lessons, protocol and reference tools, optional one time purchase modules, and an optional Registry Study subscription with original practice questions and mock exams.

2. Educational Use Only. Not Medical Advice.

• The Service is for general education and study only.
• It is not medical advice and does not create any relationship between you and a medical provider.
• It is not a substitute for professional clinical judgment, your facility's policies and official protocols, manufacturer instructions for use, MR safety guidance from your MR Safety Officer or radiologist, or applicable laws and regulations.
• Do not use the Service as the only basis for any decision about patient care, patient safety, scanning, implants or devices, contrast, or equipment. Always follow your facility's approved procedures and the direction of qualified supervising professionals.
• We work to keep content accurate, but medicine and MRI technology change, and the Service may contain errors or omissions.

3. No Exam Affiliation or Guarantee

• MRI Toolkit is not affiliated with or endorsed by ARRT or ARMRIT. Any mention of those organizations or their exams is only to describe what the study material is meant to help you prepare for. All trademarks belong to their owners.
• The practice questions and mock exams are original content written by MRI Toolkit. They are not actual exam questions and are not taken from any certification exam.
• We do not guarantee that you will pass any exam, earn any credential, or reach any score. Your results depend on many things outside our control. Practice scores in the app do not predict real exam results.

4. Your Account and Eligibility

You must be old enough to form a binding contract where you live (or have a parent or guardian's permission) to make purchases. You are responsible for your device, your Apple ID or Google account, and any activity that happens through them.

5. Purchases and Subscriptions

One time module purchases

Some modules are sold as one time purchases inside the app. After purchase, they stay available to you on the same Apple ID or Google account for as long as we offer the Service, and you can restore them with Restore Purchases.

Registry Study subscription

The Registry Study subscription unlocks the original practice questions, mock exams, and related study features. It is offered on the App Store and Google Play as:

Prices may vary by country and may include or exclude taxes depending on where you live. The price shown in the app at checkout is the price you pay.

Subscription terms:

• Payment. Payment is charged to your Apple ID account (iOS) or Google Play account (Android) when you confirm your purchase.
• Automatic renewal. Your subscription renews automatically for the same length of time and at the same price unless you cancel at least 24 hours before the end of the current period.
• Renewal charge. Your account will be charged for renewal within the 24 hours before the current period ends.
• Manage or cancel. You can manage or turn off automatic renewal at any time in your store account settings:
  • iPhone/iPad: Settings → [your name] → Subscriptions, or the App Store account page.
  • Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions.
• Deleting the app does not cancel your subscription. You must cancel in your store account settings.
• When you cancel. Cancellation takes effect at the end of your current billing period. You keep access until then.
• Price changes. If the price changes, Apple or Google will notify you as their rules require, and you may need to agree to the new price before it applies.
• Free trials or offers. If we offer a free trial or introductory price, its terms will be shown before you buy. Any unused part of a free trial ends when you purchase a subscription, where applicable.

Refunds

All payments are processed by Apple or Google, not by MRI Toolkit. Refunds are handled by Apple or Google under their own policies. We cannot issue refunds directly for App Store or Google Play purchases.

6. Our Content and Intellectual Property

All content in the Service, including lessons, explanations, diagrams, practice questions, mock exams, protocol tools, text, graphics, software, and design, is owned by MRI Toolkit LLC or its licensors and is protected by copyright and other laws.

We give you a personal, limited, nonexclusive, nontransferable, revocable license to use the Service for your own individual study and education, according to these Terms. You may not:

• copy, share, sell, republish, or distribute questions, answers, explanations, or other content;
• screenshot, scrape, or export question banks to share them or build another product;
• use the content to train AI or machine learning models without our written permission.

"MRI Toolkit" and our logos are our trademarks. You may not use them without our permission.

7. Acceptable Use

You agree not to:

• break any law, or use the Service in a way that harms others;
• copy, reverse engineer, decompile, or modify the app, except where the law allows it;
• get around purchase checks, subscriptions, or other technical protections;
• share your paid access with people who did not pay for it, except through a sharing feature the store officially supports;
• interfere with or overload the Service or try to access it without permission;
• use bots, scrapers, or automated tools to access content.

We may suspend or end your access if you break these Terms.

8. Feedback

If you send us suggestions, corrections, or other feedback, we may use it to improve the Service without owing you anything.

9. Privacy

How we handle information is described in our Privacy Policy at mri-toolkit.expo.app/privacy. Purchases are processed by Apple or Google, and we do not receive your full payment card details.

10. Changes to the Service

We may add, change, or remove features or content at any time, including updating questions, lessons, and tools. We will try not to remove the core content of something you paid for during an active paid period, but we cannot promise the Service will always be available or free of errors.

11. Disclaimer of Warranties

To the fullest extent the law allows, the Service is provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and noninfringement. We do not promise that the Service will be uninterrupted, free of errors, secure, or that content will be complete, current, or correct.

12. Limitation of Liability

To the fullest extent the law allows:

• MRI Toolkit LLC and its owners, employees, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, income, employment, certification, or exam results, arising from your use of (or inability to use) the Service.
• Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or US $50, whichever is greater.
• We are not responsible for any clinical, patient care, or safety decision made by you or anyone else.

Some places do not allow certain limitations, so some of these may not apply to you.

13. Indemnity

You agree to defend and hold harmless MRI Toolkit LLC from claims, losses, and costs (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of these Terms.

14. Apple and Google Terms

• iOS users: If you download the app from the Apple App Store, Apple's Licensed Application End User License Agreement (Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, also applies. If these Terms conflict with Apple's Standard EULA, the Standard EULA controls for iOS users to the extent of the conflict. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.
• Android users: Your use of Google Play, including purchases, is also subject to Google Play's Terms of Service.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Harris County, Texas, and you and we agree to the jurisdiction of those courts, unless the law where you live requires otherwise. Before filing a claim, please contact us so we can try to resolve it informally.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version at mritoolkit.com/terms and change the effective date above. If the changes are significant, we may also notify you in the app. If you keep using the Service after changes take effect, you accept the updated Terms.

17. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we haven't waived it. You may not transfer these Terms without our consent. These Terms, plus our Privacy Policy and any applicable store terms, are the full agreement between you and us about the Service.
